Congrats, you've successfully signed on...

Whenever you talk about law, you inevitably come across some controversy. Throughout this class, we'll talk about some of those controversial topics. We'll use this blog to discuss those topics. You'll have an opportunity to state your opinion and to comment on other people's comments. Just to start, read the article about the lawsuit filed against Obamacare by 26 states. (There is a link to the right, just click on "Obamacare") What are your thoughts on President Obama's plan for universal healthcare? What do you think of the lawsuit and the possible impending Supreme Court case?

  1. I think President Obama is just trying to do the best he can for the country through his Obamacare. He is just trying to make sure everyone is protected in the case that something happens to them or someone close to them. With universal healthcare, people wouldn't have to be worried about what happens if they get hurt or get sick, they would be covered. I think this lawsuit is ridiculous and unnecessary, as is just seems like the Republican opposition is trying anything to attack Obamacare, if not the president himself. Sure not every person agrees with the healthcare, but that doesn't mean that it should be altogether voided due to allegations of unconstitutionality. I think if and when it reaches the Supreme Court it will be a very interesting case, as they alone must interpret the Constitution, and thus their ruling will set new precedents and decide what can and can't be done Obamacare and any other similar items. Whatever the case, it is interesting to see that verbal attacks on Obamacare have become legal attacks, and as more and more people jump on the bandwagon, this will truly be a case to watch as the year goes on.

  2. Obama is attempting to do right by all Americans. His obamacare plan hopes to keep all the people safe, but i believe that forcing it upon people is wrong. I agree with some of the things that will be put into action under obamacare such as being under my parents insurance for a longer time. But the fact that the health care is going to be forced upon all Americans is unconstitutional because it goes against the constitution that built this fine nation. When the Constitution was written the country was revolting against a king that was forcing taxes upon the American citizens. Now Obama is doing the same thing in attempting to force healthcare on all Americans. The majority of states that are attempting to repeal obamacare have the right idea because they believe that Obama is being unconstitutional in his new policies on health care.

  3. As mentioned in previous comments, I to feel that Obama has only the best intentions for restoring the economy. The plan he has proposed is a very unique plan. Although he wants only the best, there are a few questionable areas in his plan. Clearly not everything proposed within the government will be agreed to by everyne, and this serves as a prime example. A pro about the plan is that no one can be denied of health care depite a pre-existing condition. Also to take into consideration is the fact that healthcare is a complex area to reform and will take time considering the low economy. A con for the plan is the "threat" of higher taxes regarding the individual mandates of the plan. As far as the court case will go, it will be very interesting to know what the result is. In the article access through this blog, it was interesting to read how republican representatives argued the plan was unconstituiotal while the democratic representatives argued it was constitutional. There were some valid arguments proposed for the side of an unconstituional act, although I fell as if the plan will be passed safely.

  4. I feel as though there are several problems with Obamacare. I do feel as though Obama's intentions are good and as though he's trying to help people, but I feel as though this is not the way to go about it. Firstly, with Obamacare, the governement has too much control over what's going on. Although it has not quite reached there yet, this plan has the potential to turn into what seems like socialized medecine, similar to what Canada has. The problem with this is that you don't get to pick your doctor and the governement has a say in whether you can get treated for a condition or not. This also could possibly keep doctors from bettering themselves because there is no competition since medecine and healthcare is in the government's hands and distributed by the government. This of course, is just a scenario of what could come with Obamacare, but the fact is that expenses go up and healthcare costs more which most people do not like, such as the 26 states filing a lawsuit. I think that the lawsuit represents what the majority of people want, and therefore should be speculated carefully before a descision is made in teh supreme court. In my opinion, I would like to see the 26 states be sucessful with their lawsuit.

  5. I believe that Obama has good intentions and a good thought behind Obamacare however there are some very large flaws within the plan. Although the goal is that everyone in the country will purchase health insurance, the bill does not address the major issue of the high expenses of healthcare. Healthcare is very expensive and Obamacare does nothing to address the issue of the high cost of health insurance. Obamacare intends to put a tax on people who do not buy health insurance therefore forcing healthcare on everyone however some people, especially with the struggling economy, will have difficulty paying for the healthcare. This plan also gives the government a great deal of power over the medical industry. Although it is pretty near impossible for the government to make any decisions with support from the entire country, with 26 states filing lawsuits, it is clear that Obamacare has some serious problems. Although Obamacare has good intentions, I believe in order for the plan to be passed Obamacare needs to make some changes.

  6. I believe that the Obama is just trying to do the right thing by having every person covered with a healthcare. I do agree that we need Health care that is afforable andf from the looks of these priviate health care companies are way to expensive. Like many bills that pass the congress this bill does need some adjustment.I think that Obama has the right idea in his mind and some on the bill, but he just need to adust the bill so that majority of the population is happy with it.If you ask me i would rather pay high taxes and get a really good healthcare,then not at all. I think that our health care should be like the European countries that are ranked as the best healthcare provides.

  7. I think Obama is attempting to do the right thing. I am certainly on the fence about the bill because there are pros and cons about the bill. The healthcare overall provides an end to the worst insurance company abuses, new rules that treat everyone fairly and more choices and affordable health insurance for millions of Americans. I think that the main purpose of the healthcare plan is to prevent people from dying because they can’t afford proper healthcare. Because of our economy, surgeries and other medical solutions are increasing in price and the whole purpose of the healthcare plan is to make it more attainable for less fortunate people. I think since it’s saving people’s lives then people should not be complaining about it. I think saving people’s lives is more important than who gets what? But then since healthcare is very expensive the Obamacare doesn’t do anything about the cost of health insurance. As the article stated that there will be tax on people who do not buy healthcare so then its going to be difficult to pay for. Overall Obama has a good plan but there are problems that need to be fixed.

  8. I believe that Obama is trying to do the right thing and has good intentions with Obamacare. By requiring everyone to be covered with a health care, it would ensure that anyone who fell ill or became injured would not have to worry about it, since they would already be covered. However, there are some problems with Obamacare. The main reason I think that health care is not cheap at all, and it would be problematic for some people to afford it. However, if people do not buy health insurance then there will be a heavy tax that they would have to pay. As stated in the article, this health care is unconstitutional because they are now forcing health care on the American people, much like back then when Great Britain tried to tax the Americans who ended up revolting. 26 states want to repeal Obamacare because they feel like it is unconstitutional and I think that their claim is valid. It will be interesting to see what comes out of this.

  9. I believe that, although the president is trying to do the right thing, he is doing it the wrong way. This bill got rid of our right to choose what to buy, thus it is unconstitutional. Obamacare is not only unconstitutional, but against the very nature of our country. We live in a dominantly capitalist society, in which competition is key. However, with the introduction of Obamacare, people will be forced to buy health insurance, thus eliminating much of the competition currently found in the health care industry. This elimination will not prove to be good for the economy. A better option would have been an option made by the government. If it was offered for a low enough price, most people could afford it, and one could still choose whether or not to have health care. In addition, this cheaper option would create greater competition in the marketplace, thus improving the economy and honoring our capitalist roots. It would also lower prices across the board, thus making health care more affordable and accessible for all. In addition, the government may eventually run all of health care this way, only with much more gradually, and much less fuss.

Although I agree that there are multiple flaws in Obamacare, I fully support having universal health care and I think that this is a necessary step to take towards ensuring that no Americans are denied health care services because of circumstances that may be beyond their control. Obamacare is not being forced on Americans as much as many people seem to believe; most of us will not change health care providers or have our health care compromised in any way. Instead, Obamacare is an available resource for those less fortunate than most of the people that are posting on this blog. In my opinion, the negative economic consequences are a necessary sacrifice that must be made to support all Americans in their basic right to life, which includes good health. Nearly all other nations already have universal health care, and nearly all other nations have more effective and well-liked health care - I don't think that's a coincidence. Still, I understand the lawsuit even though I don't agree with it, and I think it's perfectly reasonable to test the lawsuit in court if so many Americans disapprove of Obamacare.

  11. Although the current health care system certainly needs reform, Obamacare is not going to fix it. The issue with health care is its expense, which Obamacare fails to address. It is difficult to find any exact numbers concerning the expense of Obamacare. The Congressional Budget Office, or CBO, does not seem to be a reliable source after changing its initial estimate; however, it seems that it will cost the nation more money than it will save. Moreover, Obamacare only benefits those who do not have health care and will increase the amount our generation has to pay for it. Efforts would be best spent developing better technology to reduce the cost of healthcare, rather than force Americans to pay for a bill that they did not want to pass in the first place.

    I agree that the new health care law is unconstitutional. The judge made a fair point that our country was founded in opposition to a government forcing the American people to buy tea, and that forcing Americans to purchase health care is no different. Obamacare was rushed and definitely needs to be revised.

  12. I would agree that Obama is only trying to do what he thinks is best for the country. However, i think his healthcare plan is going to bring more negatives then positives. Free healthcare will only put the country further in debt due to its high cost. It will also destroy current highend healthcare companies. The fee for these programs will become so outrageous that no one will be able to afford them, in turn putting the company under. Also, forcing healthcare on people is in my opinion a bad idea. Therefore, I would have to agree that the healthcare law is unconstitutional. In America's current state, Obamacare is not necessary.

  13. As many others have said before me, I agree that Obama is trying to do what he believes is best for the largest majority of the United States. I do think that the idea behind ObamaCare, being that everyone in the country has healthcare, is something that is important. But, like most things in our economy today, Money is the ultimate factor. In a time where the country was wealthier and more stable then ObamaCare would be something that would truely help all of the United States, but until then it won't.
    Similar to the majority of the states, I agree that forcing healthcare for all citizens of the United States is unconstitutional. It is the same as if they forced all people to have car insurance, but obviously on a smaller scale. If people want the insurance, they can get it, if they can't afford it their should be a plan to help them, but it doesn't have to be mandatory.

I think that the court's decision to deem Obamacare unconstitutional is purely for political reasons because Obama's plan was actually presented years before, but as a Republican idea when Pres. Nixon first put it forward. As for the mandate itself, I disagree with the President's plan. It will allow for private insurance companies to make even more profits. I am a strong supporter of universal single-payer system, and think that private insurance companies should be eliminated, as their main goal is to make a profit and when it comes to healthcare it should'nt be about profits. The U.S. is the only modern industrialized country in the world that doesn't have universal care. Not all of these countries have done it as well, but countries like Cuba, Sweden, and Finland provide excellent examples of how extrodinarily well and inexpensive it can be done. Some parts of the plan are good though, like keeping children on their parent's plans until they're 26, and those parts should be kept and even expanded.

  15. Healthcare Reform is something that was fought for by Democratic Presidents for decades. Republicans view that the new law will make it, as the article says, "difficult to perceive any limitation on federal power." Republicans must fight this issue in order to stand any chance in winning elections. I agree with Obamacare because when I become an adult and need to start paying for my insurance, I wouldn't have to feel insecure about my health and the fact that I may not be treated because I can't afford it. America is one of the only countries without universal healthcare. Why should we be different from the rest of the world? The fact that there are still people who are trying to deem it unconstitutional shows that there is a lack of bipartisanship and will cause the country to progress slowly.   17. I think that Obama is trying to do his best to help everyone. Not all of us have a well paid job. Some people have difficulties paying their monthly bills imagine about paying a health care wich all we know is expensive. Obamacare would really help people that are unable to pay health care and give everyone the chance to be safe in case that something happens to them even though they are economically weak.

  18. I think obamacare is unrealistic. Many people enjoy their current health care situation and the people who don't don't want to pay more taxes for universal health care. Also there's not enough support and if it was going to happen it would have already happened. The lawsuit is a little extreme and i don't agree with it. Even if it gets approved or what ever it's not a major problem for the country.

  20. I think that obamacare has good intentions, but violates or is definetely on the border of violating a great deal of rights. I think what Obama was trying to do is to make sure that everyone is protected and that everyone has health insurance if and when they need it. However forcing people to have it probably doesn't give people the right idea of his intentions. In Massachusetts it is illegal not to have car insurance....it doesn't seem that people make a big deal about that. I know it is separate and is obviously on a much smaller scale, but is the same idea. I think that other states making a big deal about this is a little ridiculous. Overall I am not sure that I agree with Obamacare, but I still think it is a good idea that people have insurance for their sake and for the safety of others, but making it illegal not to have it seems extreme too.

I disagree with most of what is in Obamacare, he tries to force people to accept and get his new healthcare by taxing anyone that thinks they dont need it. the point that i really agree with is that he is allowing adult children to stay on their parents coverage for a longer period of time. This helps out a lot of the college kids that really sont have the time and effort to worry about finding their own health care plan while still in school.
